Purpose

The purpose of this website is to provide a simple and convenient food ordering services to consumers in the local vicinity of Andrew’s Hamburgers locations.

By using this website, your primary purpose is to place an online order, browse the menu, and view contact and location information for Andrew’s Hamburgers.

As an authorized agent of Andrew’s Hamburgers, Trendplate processes online order requests for customers on the Andrew’s Hamburgers website and passes the orders through to Andrew’s Hamburgers via a Trendplate app. Andrew’s Hamburgers is responsible for the fulfilment of the order. The Andrew’s Hamburgers website may also be managed by Trendplate.

Online orders

Trendplate deals with reputable third parties, such as, but not limited to, payment gateways, email gateways, marketing and analytics providers and hosting providers; who provide a quality service for Trendplate to process online orders on behalf of Andrew’s Hamburgers. Trendplate accepts to responsibility or liability for the quality of any goods and services delivered or collected by third parties.

If you use the online ordering features and functionality of the website, then you must only use the website if you are 18 years or older, or under the supervision of an adult or guardian that is 18 years or older. You agree to accept full responsibility for all your activities on the website and online ordering. You agree that you are solely responsibility for maintaining the confidentiality of your personal details and payment details.

It is your responsibility to ensure that your order is correct at the time of placing the order. Once your order has been made, it cannot be modified. You can contact Andrew’s Hamburgers direct to make any amendments, however Andrew’s Hamburgers reserve the right to charge you extra for any order amendments. Any charge amendments made as a result of a change agreed between you and Andrew’s Hamburgers, will not be processed by Trendplate.

Andrew’s Hamburgers reserves the right to enforce a minimum order value and/or an online order processing fee.

Once you have submitted an order, you will receive an Order Number and a Tax Invoice / receipt will be emailed to the email address you supplied when placing your order.

When you make an online order with Andrew’s Hamburgers on the website, you will be charged by Trendplate.

If Andrew’s Hamburgers cannot fulfil your order (e.g. due to no stock), Andrew’s Hamburgers will reserve the right to change your order or refund, in part or in full, your order at its sole discretion. If your order is changed, a confirmation email will be sent to the email address you supplied when placing your order. Trendplate or Andrew’s Hamburgers are not responsible for any delays with communication due to issues with your contact details (e.g. email address and phone number) when placing your order.

It is your responsibility that you provide the correct email address when placing your order. It is also your responsibility that your email settings, spam setting or junk email settings will allow you to receive order emails from Trendplate and Andrew’s Hamburgers.

All food preparation and order fulfilment is the sole responsibility of Andrew’s Hamburgers. Andrew’s Hamburgers may provide an estimated pickup time, which should only be used an indicative timeframe. Trendplate or Andrew’s Hamburgers is not responsible for any inaccuracies with estimated pickup times.

Once your order has been received by Andrew’s Hamburgers, this represents an agreement between you and Andrew’s Hamburgers. Andrew’s Hamburgers is solely responsible for the fulfilment of your order. Any issues with your order should be made directly with Andrew’s Hamburgers.

By placing an online order on the website, you acknowledge that Trendplate will be processing your order as an authorized agent of Andrew’s Hamburgers. Your credit card / bank statement may display Trendplate as the merchant. You acknowledge that you will not raise a chargeback with your Credit Card provider due to a difference in merchant name.

Online orders are made for pickup at the store that you select and it is your responsibility to make sure that you pick up your order in time. Unclaimed orders are not the responsibility of Trendplate or Andrew’s Hamburgers and you will not be refunded if you do not pick up your order.

In the event of a dispute or a chargeback made by you, you should contact Trendplate to resolve the dispute. If Andrew’s Hamburgers has verified that the order has been received and processed, the Trendplate may reserve the right to re-charge you for the original order amount plus any chargeback costs incurred by Trendplate and Andrew’s Hamburgers.

Trendplate and/or Andrew’s Hamburgers reserves the right to refuse service, terminate your access to the website and/or online ordering, remove or edit any content or cancel any orders in its sole discretion and without notice to you.

Trendplate and/or Andrew’s Hamburgers does not guarantee that the online ordering services and/or the products available for online ordering will be 100% available during trading hours.

All prices are in Australian Dollars (AUD) and include GST (Goods and Services Tax), except where noted. Prices are subject to change and all goods and services are subject to availability. 

Refunds

If you need to change your order or wish to cancel your order, you will need to contact Andrew’s Hamburgers. It is the sole discretion of Andrew’s Hamburgers whether to honour your change / refund request.

Andrew’s Hamburgers can make one amendment to your order to issue a refund to your order, in partial or in full. If you make more than one amendment, the arrangement is between you and Andrew’s Hamburgers and Trendplate is no longer involved with any subsequent amendments. Trendplate will still charge your original online order and adjust the first online order amendment.

Andrew’s Hamburgers reserves the right to cancel any order at its sole discretion. In most cases, the order will be processed via Trendplate and a notification will be sent to the supplied email address at the time of placing the online order.

If your order has been processed and you are unhappy with the goods and services provided by Andrew’s Hamburgers, it is up to the sole discretion of Andrew’s Hamburgers with how your online order is resolved. Your original online order will still be charged by Trendplate, and you acknowledge that any resolutions will be made directly between you and Andrew’s Hamburgers.

You also acknowledge that Trendplate is not responsible for any issues arising from the good and services provided by Andrew’s Hamburgers. You also acknowledge that you won’t issue a chargeback request against Trendplate.

Content

The Andrew’s Hamburgers website may also include other content that is not covered by these Website and Online Ordering Terms and Conditions. In such cases, Trendplate has not verified the accuracy of the content or information and makes no guarantees about the content or information provided.

Trendplate is not responsible for any content provided by Andrew’s Hamburgers.

Any content on Trendplate and/or Andrew’s Hamburgers by third party websites may not be endorsed by Trendplate and/or Andrew’s Hamburgers. Trendplate and/or Andrew’s Hamburgers may provide links to third party websites. Trendplate and/or Andrew’s Hamburgers is not responsible for any content posted and hosted by third party websites.

Registration and accounts

From time to time, Andrew’s Hamburgers may ask you if you want to register to a member database. The member database belongs to Andrew’s Hamburgers and may be used for marketing or order auditing purposes.

During member registration, your data may be passed through the Trendplate website for the purpose of verification, validation or third-party transmission, however it will always remain the property of Andrew’s Hamburgers.

Trendplate may have access to the database for managing the database on behalf of Andrew’s Hamburgers. Trendplate does not own any member registration or member account information that is made under the purpose for registering to [Cilent Name] database.
